Terms of Service
1. General provisions
1.1. These terms govern the use of the bookup.ge platform (hereinafter "BOOKUP" or the "platform"). The platform is operated by VAIS LLC (identification code: 404706181; legal address: Krtsanisi Street 1/7, Tbilisi) (hereinafter "we").
1.2. By registering on the platform or using it, you confirm that you have read and agree to these terms. If you do not agree to the terms, please do not use the platform.
1.3. Only persons who have reached the age of 18 may use the platform.
1.4. The terms are available in Georgian, English and Russian. If there is any discrepancy between the versions, the Georgian version prevails.
1.5. The processing of personal data is described in the Privacy Policy, and the use of cookies in the Cookie Policy. Both documents form part of these terms.
2. Definitions
"Host": a person who lists property (for example, an apartment or a car) on the platform for booking.
"Co-host": a person whom a Host grants the right to take part in managing the Host's account.
"Guest": a person who books property through the platform.
"Listing": the description, photos, price and terms of a property listed by a Host.
"Booking": an agreement between a Guest and a Host on the use of a property on specific dates.
"Host page": a Host's public page at bookup.ge/[host address].
3. Account
3.1. When registering, you must provide accurate and up-to-date information.
3.2. You are responsible for protecting your account password and for all actions performed from your account. If you suspect unauthorised access to your account, change your password immediately and write to us.
3.3. With a single Guest account, you can book with any Host on BOOKUP.
3.4. You may request deletion of your account at any time. The consequences of deletion are described in the Privacy Policy.
4. The role of BOOKUP
4.1. BOOKUP is a technology platform: it helps Hosts list property and manage bookings, and helps Guests make bookings.
4.2. The booking contract is concluded between the Host and the Guest. BOOKUP is not a party to that contract.
4.3. BOOKUP does not receive or process booking payments. After the booking is confirmed, the BOOKUP system generates an invoice for the Guest in the Host's name; the issuer of the invoice is the Host. The Guest pays the booking amount directly to the Host in accordance with the invoice. Refunds are the Host's obligation and are made in accordance with the cancellation terms the Guest agreed to when booking.
4.4. BOOKUP does not verify the accuracy of Listings, the condition of property, or the conduct of Hosts and Guests. The relevant Host or Guest is responsible for these.
5. Terms for Hosts
5.1. Subscription. Use of the platform is paid for Hosts. Plans, their prices and limits (for example, the number of Listings) are published on the site. If the number of Listings or Co-hosts exceeds what the current plan allows, the excess ones are paused until the plan allows them again. Paused Listings and Co-hosts are kept, and 5.4 does not apply to them: a paused Listing is not shown publicly and cannot be booked, and a paused Co-host cannot use the dashboard. The Host chooses which ones stay active. After registering, a Host receives a free trial period, the length of which is stated at registration. During the trial period, the limits of the largest plan apply.
5.2. Payment. The subscription fee is paid monthly according to a BOOKUP invoice: by bank transfer and, once online payment is available, by card through the payment provider. When paying by bank transfer, the subscription is activated after an administrator confirms the payment. Prices are stated in GEL, including VAT. A change of plan takes effect from the following month.
5.3. Non-payment. If the trial or paid period ends and the next payment is not made, the account is suspended. While suspended, the Host can view the dashboard but cannot make changes, and the Host page no longer accepts new bookings. Bookings already made remain unchanged. Once payment is made, the account is restored immediately.
5.4. Deletion of a suspended account. If an account remains suspended for 12 months, it is closed: the Host's personal data (name, email address, phone number and legal details) is deleted, and the Host's page and listings are no longer available to anyone. We will notify the Host of this by email 30 days before closing and again 7 days before. Records of bookings and invoices, and other financial records, are kept for the period established by law.
5.5. Cancelling the subscription. A Host may cancel the subscription at any time, from the dashboard or by writing to info@bookup.ge. After cancellation, the platform continues to work until the end of the current paid period, and the next payment is not charged. When the paid period ends, the account becomes view-only as described in 5.3, and the 12-month period of 5.4 begins. Amounts already paid are not refunded, unless the law provides otherwise.
5.6. Host obligations. The Host must:
a) provide accurate information in the Listing: the description of the property, price, availability and cancellation terms;
b) hold all permits and rights necessary to list the property for booking, and fulfil their own tax obligations themselves;
c) honour confirmed bookings; if a booking is cancelled, explain the reason to the Guest and, where applicable, refund the amount in accordance with the cancellation terms;
d) use a Guest's personal data only to fulfil the booking and process it in accordance with the law; the Host is independently responsible for this data;
e) be responsible for the actions of their Co-hosts in the same way as for their own actions;
f) before the Host page becomes public, provide complete details (a personal number for an individual or an identification code for a legal entity, and a bank account for invoices), a contact phone number and a confirmed email address.
5.7. Photos and text. The photos, logo and text added on the Host page and in Listings belong to the Host. The Host confirms that they have the right to use them, and grants BOOKUP a free, non-exclusive permission to display this content on the platform for as long as the account is active.
5.8. Host page address. The Host chooses the address bookup.ge/[host address] at registration and may change it later in the account settings. After a change, the old address does not redirect to the new one, so links to it stop working. For 30 days the old address (only the most recent one) is kept for that Host, and nobody else can register it. Some addresses are reserved and cannot be chosen.
6. Terms for Guests
6.1. Booking. A booking can be of two types:
a) instant booking: the booking is confirmed immediately;
b) booking request: the Host must respond to the request within the time limit they have set. If the Host does not respond within that time, the request automatically expires and the dates are released.
6.2. Price. The price of a booking is fixed at the time of booking and does not change afterwards.
6.3. Cancellation terms. If a Listing has cancellation terms, you must agree to them when booking. The date and time of your agreement are recorded on the booking. You may cancel your booking from your personal dashboard. The Listing's cancellation terms determine the rules for cancellation and refunds.
6.4. Payment and contact. After the booking is confirmed, you will receive an invoice by email and in your personal dashboard; you pay the booking amount directly to the Host in accordance with the invoice. After the booking is confirmed, the Host's phone number and email become available to you, so that you can agree the payment and visit details with the Host.
6.5. Additional information. For bookings of certain types of property, the Host may need additional information (for example, driving licence details for a car booking).
6.6. Reviews. After your visit ends, you may leave one review and comment for each booking. A review must be accurate and honest. The author's first name and the first letter of their surname (for example, "Nino B.") are shown on the Host's public page. The Host may write a public reply to a review.
7. Prohibited actions
The following are prohibited on the platform:
a) creating fake bookings, including for the purpose of blocking dates;
b) listing property or content that you do not have the right to list;
c) posting unlawful, offensive or misleading content;
d) circumventing the platform's security mechanisms, overloading the system, or mass collection of data by automated means;
e) using other users' data for any purpose other than the booking.
8. Suspension and blocking of accounts
8.1. If these terms are breached, we may hide content, or suspend or block the account.
8.2. If a Host is blocked, the Host page and the dashboard are closed, but support remains available so that the Host can appeal the decision.
8.3. If a Guest is blocked, the Guest cannot create new bookings; bookings already made remain unchanged.
9. Intellectual property
BOOKUP's software, design and brand belong to VAIS LLC. Clause 5.7 applies to Host content.
10. Limitation of liability
10.1. The platform is provided on an "as is" basis. We try to keep the platform working without interruption, but we do not guarantee its uninterrupted operation.
10.2. BOOKUP is not responsible for the relationship between the Host and the Guest: for the condition of the property, performance of the booking, payment or refunds.
10.3. This limitation does not apply where the law does not permit limitation of liability, and does not restrict the rights granted to a user by law.
11. Changes to the terms
If the terms change, the new version will be published on the site. We will notify registered users of significant changes by email at least 14 days before the changes take effect. If a change significantly alters your rights or obligations, we will ask for your consent to the new version again.
12. Governing law and dispute resolution
These terms are governed by the laws of Georgia. In the event of a dispute, please first write to us at info@bookup.ge: we will try to resolve the dispute through negotiation. If this is not successful, the dispute will be heard by a court of Georgia. Users residing in the European Union retain the mandatory protection granted to them by the laws of their own country.
